The Ministry of Economy proposed to remove criminal, administrative and civil liability for the parallel import of goods from the list of the Ministry of Industry and Trade.
The authorities want to protect businesses from copyright holders whose goods were allowed to be imported into the country by roundabout routes.
Now the illegal use of trademarks is punishable by a fine of up to 200 thousand rubles with confiscation of products, and the illegal use of industrial designs and inventions by imprisonment for up to five years.
If the bill is passed, importers will be protected from possible claims from right holders, that is, they will be more willing to import goods into the country. But the bill, according to lawyers, needs to be improved: it is necessary to specify the conditions under which such guarantees cease to be valid, and also indicate how the rights of manufacturers who decide to independently sell goods from the list will be protected.
