Apple must pay compensation to a Brazilian buyer who recently bought an iPhone for selling the device without a charger in the box, which is a violation of consumer law, a judge ruled.
Apple’s decision to remove the charger from the box caused controversy back in 2020. The company claims this is being done for environmental reasons, saying it’s the equivalent of taking nearly 450,000 vehicles off the road a year.
However, the move sparked outrage from the public and lawyers. A Brazilian judge, in a country that has long questioned the validity of Apple’s decision to remove the accessory, has ordered the company to pay a buyer $1,075 in damages for missing the charger, according to the latest reports. how informs Tecmundo edition:
“According to article 39 of the Consumer Protection Code, such a sale is illegal and prohibited in Brazil, so it is not allowed to sell a cell phone and charger separately. Apple was convicted of selling the iPhone and charger separately to a buyer in the city of Goiania.
According to the ruling by Judge Wanderlei Cayres Pinheiro of the 6th Civil Court of Goiania, Apple must pay the consumer a compensation of 5,000 reais for making such a sale of devices.”
Brazil already fined Apple $2 million last year for violating consumer laws and disrespecting Brazilian customers.
At one point, it seemed plausible that Brazil would force Apple to include a charger in the box for every iPhone sold in the country. Law firm Procon-SP said the charger is an “essential part” of using a smartphone.
By not supplying the charger with the smartphone, Apple violated the Brazilian Consumer Code, according to the consumer protection agency. In response, Apple said that many customers already have chargers at home, adding to this the environmental feasibility.
