Article 58 of the Law on the Protection of Minors stipulates that the business premises of Internet access services shall not admit minors. Minors over the age of 16 can check in at the hotel with their ID card.
On May 12, the People’s Procuratorate of Suqian City, Jiangsu Province sued the defendant in a civil public interest lawsuit against a hotel management company for providing Internet services to minors. This is also the first civil public interest litigation case in the country.
In April 2021, the prosecutor of the Sucheng District Procuratorate learned from the teacher that some students often go to the “e-sports hotel” to surf the Internet during the rule of law class. After obtaining the clues, the procuratorial organ immediately launched the investigation procedure.
The survey found that “e-sports hotels” provide Internet services with the same configuration as Internet cafes, and have been favored by minors in recent years.An e-sports hotel in Sucheng District is one of them. In just three months, there were 387 online records of minors.
Some mothers approached the boss because their children often went to an e-sports hotel to ask for an explanation, but the boss said that the hotel was not an Internet cafe and that minors could be accommodated with the consent of the guardian. The boss also took out the registration form for minors to confirm that he had obtained the consent of his father. But in fact, the phone number was filled in by the child himself, and the hotel did not actually call to verify.
Prosecutors believe thatThe hotel’s main purpose and consumption method are to provide Internet access services, and it belongs to the business premises of Internet access services.As a business place, it is open to the public. Because of providing Internet access services to unspecified minors, the legitimate rights and interests of many minors and families are at risk of being infringed.
In the end, the court ruled that the defendant was prohibited from providing Internet access services to minors, and within 10 days from the date when the judgment came into effect, a written apology was made to the public in the national-level public media.
